VIDEO ONLY CONTRACT/TERMS

TERMS OF SERVICE..Our contract protects both parties by clearly stating what each party can expect from the other. It prevents misunderstandings and gives both parties the confidence they need to feel comfortable about each other. We insist on a contract. You should too! It's the best way to do business by far. We think it is very important that you have the opportunity to look our contract over. If you have questions, please feel free to inquire.

SCOPE AND PURPOSE: This contract supersedes and replaces any previous understanding, agreement or contract, written or verbal, between A Moment to Remember (hereafter referred to as The Studio and comprised of its corporate officers) and the contracting party (hereafter referred to as The Client). The purpose of this contract is to protect both The Client and The Studio. The day of the event is no time for misunderstandings and oversights to surface, and this contract seeks to alleviate this possibility.

RESERVATION OF TIME AND DATE: This contract constitutes an order for a wedding video. Upon execution of this contract and receipt of the reservation fee (deposit), The Studio will reserve the time and date agreed upon. If the payments are not received at The Studio by the dates specified, The Studio may cancel the reservation without further notification to The Client (verbal or otherwise). This does not guarantee a videographer for any rehearsal dates. It is understood that A Moment to Remember videographers are booked for their time, and videography is not guaranteed if the event does not adhere to the agreed upon event schedule, although all efforts will be made to provide overtime if possible.This reservation does not guarantee your videographer will be the person with whom you have been contacting at The Studio, and it is the right of The Studio to schedule any professional staff videographer for the event.
CHANGE OF DATE: The Studio will make reasonable effort to work with The Client should changes occur. If the event is rescheduled, and if The Studio is available, The Studio will shoot the new date at the current rates in effect at the time of the change. If The Studio is not available on the new date The Studio is obligated to refund payments made, less the non- refundable deposit. If the event is canceled and not rescheduled the Studio will refund payments made, less the non-refundable deposit. One week’s notice is required to receive refund payments for a canceled event. Without one week’s notice, The Studio is not obligated to return any payments made. Should The Studio fail to receive scheduled payments timely, all payments will be forfeited, and The Studio will be under no further obligation in any way to The Client. The Studio must be notified in writing of any changes.

PRODUCTION AND EDITORIAL CONTROL: The Client has had ample opportunity to critically view samples of The Studio's video work, and has retained The Studio as the exclusive official videographer to cover the event. The Client grants The Studio full production and editorial control regarding all aspects of production and postproduction. The Studio makes no guarantees either expressed or implied in regard to aesthetic qualities of the completed video production. The Studio makes no guarantees concerning any particular effect, interview or special request. In the event that a particular segment of the event is not recorded, partially recorded, or recorded but not included in the Edited Master Videotape, it is at the sole discretion of The Studio as the exclusive producer of the event videotape. It is imperative that The Client mention any special topics that must be covered in the video at the signing of this contract or on the editing worksheet. The Studio is not liable for events uncovered. When studio videographers must travel to locations beyond the ceremony and reception location, it must be mentioned in the contract and additional fees may or may not be applicable.

RESTRICTIONS: The Client is aware restrictions imposed by others (e.g., photographer, church, reception hall, guests, etc.), and the constraints of the physical environment, safety, weather, and acts of God can affect the quality and extent of video coverage possible. The Studio guarantees coverage of all events only within the bounds of any restrictions and constraints of the physical environment, safety, weather and acts of God. The Studio cannot guarantee coverage of outside events during inclement weather. The Client is responsible for obtaining all permissions and clearances, etc., and adequate shelter from inclement weather and extreme temperatures as required by The Studio to operate. Electromagnetic interference within the radio frequencies utilized by wireless microphones systems may be caused by many sources, including but not limited to other wireless microphone systems, radio and microwave transmitters, aircraft and other unexpected sources. The Studio will take all measures to correct problems caused by interference, but cannot guarantee interference free wireless audio recordings.

PRODUCTION MATERIALS: Photographs, wedding invitations and programs, music, special instructions, checklists, and any other materials supplied by The Client required for the completion of the production must be received by The Studio at least two weeks before the event date. All materials will be returned to The Client with the delivery of the finished product. Although all possible care will be taken to safeguard these materials, The Studio is not responsible for any materials lost or damaged while in possession of The Studio or in transit beyond replacement cost. If the client does not deliver the materials needed for the completion of the video i.e. photographs, music, etc. two weeks before the event, the Studio is under no obligation to use such materials in the final product, and is not entitled to any refund of payment, nor does the videotape need to be delivered on time.

PROPERTY RIGHTS: The Client warrants that he/she has the legal rights to anything the studio will videotape, including photos, musical recordings, videotapes, or any other materials delivered to The Studio for inclusion in The Client's videotape. The Client agrees to indemnify and hold The Studio harmless for any loss, damage, or liability for infringement of any rights arising from the use or sale of tapes The Client hires The Studio to produce, edit, or duplicate.

DISPLAY RIGHTS: In signing this contract, The Client is acting as agents for all members of the party and guests and grants The Studio all rights for display, airing, exhibition, promotion, newsletter, contests, and advertising use of all videotapes produced under this contract.

FOOD AND PARKING: The Client will provide food for The Studio staff during the guest meal service. One meal is required for Economy plus, Bronze and , and two meals for Gold, Silver and Platinum packages. 2 meals are required should the client add an additional videographer to the reception. The Client will provide parking for The Studio's vehicle as close to the event as possible.

OVERTIME: When event activities extend beyond the agreed upon time frame designated by The Clients purchased package, and The Client requests extended coverage, overtime will be billed in half hour increments at $50 per half hour, until such time as The Client has departed or informs The Studio to discontinue.

TRAVEL: Events which occur outside of Central Florida will incur a travel fee. No travel fee is incurred for Seminole, Lake, Orange or Osceola counties. The fee is based on the current IRS mileage rate, and is for each videographer booked, round trip.

DELIVERY OF VIDEO: Normal delivery of The Client's video is within 15 weeks of the event. This delivery schedule is only approximate, and among other factors, is dependent on The Studio having received all production materials supplied by The Client for inclusion in the videotape. An extended delivery schedule necessary for proper completion of the event videotape will not void this contract. Additional copies are available at $25 per DVD, and are usually available for months after the delivery date. The Studio will ship the video to a location in the contiguous United States free of charge. It is important that you view the video immediately, as any editing changes or found defects you wish to correct can only be accomplished within the first 14 days after it is delivered to the Client. The Terms "Full Reception Film" and "Full Ceremony Film" refer to the editorialized versions of the Ceremony and Reception formalities such as Cake Cutting, Bouquet Toss, and Special Dances. The Full Ceremony Film and Full Reception does not guarantee any specific filler shots (b-roll) will be included. Should The Client want access to any specific filler shot (b-roll), they may purchase the raw footage.

STUDIO LIABILITY AND GUARANTEES: The Studio limits any liability for loss, damage, or failure to deliver the event videotape for any reason to return of all payments made. The studio will make a concerted effort to videotape testimonials in a package that offers them, but can not guarantee that any person at the event will speak to the camera or will volunteer to be videotaped. Recordable DVD-r’s can degrade over time. It is important that you make copies or order additional ones from us.

PAYMENT: There is a 25% Non-Refundable date reservation fee required upon completion of this contract. The remaining 75% is due two weeks before the event. All payments are to be made out to A Moment to Remember. We accept cash, credit, check or PayPal to: contact@amoment2remember.com
